2. Purpose and acceptance

These Terms and Conditions (the “Terms”) govern your use of the Mochi app on iOS and Android. By creating an account or using the app, you accept the Terms. How we process your data is described in our Privacy Policy.

3. The service

Mochi is a wellbeing app that offers:

• guided meditations, breathing exercises and sleep content;

• a personalized program generated by artificial intelligence from your onboarding answers;

• progress tracking (levels, experience points, streaks) and virtual rewards (coins, cosmetic items for the mascot);

• downloads of some audio sessions for offline listening.

Some content is free. The rest requires a paid subscription.

4. Eligibility and age

Mochi is for people aged 13 and over. If you are under 18, you must have the permission of a parent or guardian, who accepts the Terms on your behalf and remains responsible for your use, including purchases. AI personalization also requires parental consent under 15 (France) or 16 (Germany), or the age set by the law of your country.

5. Account

You can create an account with Apple, Google, or an email address and password. You agree to:

• have only one account and provide accurate information;

• keep your credentials confidential;

• tell us at agency.mosaik@gmail.com if your account is used without your permission.

You are responsible for activity on your account, unless it results from a failure on our part.

6. Subscription and payment

Purchase. The subscription is sold only through Apple's App Store or Google Play. The price, duration and applicable taxes are shown in the store before you buy. Payment is handled by Apple or Google; we never receive your card details.

7-day free trial. New subscribers may get a 7-day free trial, depending on their eligibility in the store. To start the trial, you need a valid payment method registered with Apple or Google. You are not charged during the trial. At the end of the 7 days, the subscription starts automatically and the price shown in the store is charged to your payment method, unless you cancel at least 24 hours before the trial ends.

Auto-renewal. The subscription renews automatically at the end of each period, and your payment method is charged, unless you cancel at least 24 hours before the end of the current period. If the price increases, the store will inform you and, where the law or its rules require, ask for your consent.

Cancellation. Cancel from the subscription settings of your Apple or Google account. Deleting the app or your Mochi account does not cancel the subscription. Cancellation takes effect at the end of the current period: you keep premium access until then.

Refunds. Refund requests are handled by Apple or Google under their own policies, without prejudice to your statutory rights.

Restore purchases. On a new device, sign in to the same Mochi account and tap “Restore purchases” in the app.

7. Right of withdrawal (EU consumers)

If you are a consumer living in the European Union, you generally have a 14-day right of withdrawal from your purchase. Because the purchase is made from Apple or Google, you exercise this right with them, following their procedures.

However, if you request immediate access to premium content during that period and acknowledge that you lose your right of withdrawal, as presented by the store at the time of purchase, the right can no longer be exercised once access has begun (Article L221-28 of the French Consumer Code). During the free trial, you can cancel at no cost.

8. Virtual items

Coins and cosmetic items are earned only by using the app; they cannot be bought with real money. They have no monetary value and cannot be exchanged, transferred, converted or refunded. They are licensed to you, not owned by you. We may modify, rebalance or reset them, in particular in case of bugs or abuse. They are lost when you delete your account.

9. AI-generated content

Your personalized program is generated automatically by an artificial intelligence model provided by OpenAI, based on your answers. It may be incomplete, inaccurate or unsuited to your situation. It is a content suggestion, not professional, medical or psychological advice. Use your own judgment and ignore any suggestion that does not suit you.

10. Health and safety

Mochi is not a medical device. The app does not diagnose, treat, cure or prevent any disease or condition. It does not replace a doctor, psychologist or therapist. If you are under treatment or unsure about your health, talk to a professional.

Mochi is not an emergency service. If you are in distress or thinking about suicide, get help immediately:

Breathing exercises. Do them sitting or lying down, never while driving, in water, or in any situation that needs your attention. Stop immediately and breathe normally if you feel dizzy, short of breath, tingling, pain or discomfort. Consult a doctor before doing them if you are pregnant, or if you have a respiratory condition (asthma, COPD, etc.), a cardiovascular condition, epilepsy or panic disorder. Do not listen to sleep content while driving.

Breathing test. The test in the app is a playful indicator. It is not a medical measurement of your lung capacity.

Scientific references. When we cite scientific research, we use real, verifiable sources. Such research describes average effects observed in studies; it does not guarantee any individual result.

11. Acceptable use

You agree not to:

• decompile, disassemble or reverse engineer the app, except where the law allows it;

• copy, extract or scrape the content (audio, voices, texts, images), or redistribute it;

• access the service by automated means (bots, scripts) or bypass technical protections;

• overload or misuse our servers or AI features, for example by repeatedly generating programs;

• cheat (coins, progress) in a way that harms the service;

• enter unlawful content or other people's personal data.

If you breach these rules, we may suspend or delete your account, after warning you where possible and proportionate. If your account is deleted through no fault of your own, you may request a refund of the remaining subscription period.

12. Intellectual property

The app and all its content (audio, voices, music, images, mascot, texts, trademarks, code) belong to the publisher or its licensors. We grant you a personal, non-commercial, non-exclusive, non-transferable and revocable license to use the app on your devices while your account exists. Audio downloaded for offline listening can only be played within the app.

You keep ownership of the text you enter (for example, the free text during onboarding). You grant us only the right to use it to provide the service, in particular to generate your program, and for as long as needed.

13. Third-party services

Parts of the service rely on third parties: Apple and Google (sign-in, payment, app stores), RevenueCat (subscriptions), OpenAI (program generation). Their own terms apply to those parts.

App Store. If you download Mochi from the App Store, Apple's standard Licensed Application End User License Agreement applies, and these Terms supplement it. These Terms are between you and the publisher, not Apple. Apple is not responsible for the app, its content, maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

14. Account deletion and termination

You can delete your account at any time in the app: Settings, then Delete my account. Deletion permanently erases your account data, program, history, progress and virtual items, as described in the Privacy Policy. Remember to cancel your subscription in the store: deleting your account does not cancel it.

We may discontinue the service or the app with at least 30 days' notice. In that case, we will refund any paid and unused subscription period.

15. Liability

You benefit from the statutory guarantee of conformity for digital content and services under the French Consumer Code.

We do our best to keep the app working properly, but we do not guarantee uninterrupted or error-free access. We may interrupt the service for maintenance, or update the app and change its features or content, without removing the core of what your current subscription covers.

To the extent permitted by law, we are not liable for indirect damages, or for damages resulting from use of the app contrary to these Terms or to the warnings in section 10. These limits never apply to personal injury, gross negligence or wilful misconduct on our part, nor to the rights the law grants you as a consumer.

16. Changes to the Terms

We may change these Terms, for example to reflect changes to the app or the law. For significant changes, we will notify you in the app or by email at least 30 days before they take effect. If you do not accept the new Terms, you can delete your account and cancel your subscription before that date. By continuing to use the app after that date, you accept the new Terms.

17. Governing law and complaints

These Terms are governed by French law. If you are a consumer living in another country, you keep the protection of the mandatory rules of your country.

Complaints. Please contact us first at agency.mosaik@gmail.com: we always look for an amicable solution.

Courts. Failing agreement, the dispute may be brought before the competent courts. As a consumer, you may in particular bring a claim before the courts of your place of residence. No arbitration clause is imposed on you.
